Customer terms

Version 2026-11

Draft for legal review. This version is not yet in force, and text in square brackets is still to be decided.

1. About these terms

These terms are an agreement between [registered company name], a company registered in England and Wales (number [company number]) whose registered office is at [registered office address] ("Everplace", "we", "us") and the organisation named when its Everplace workspace was created ("you"). The person who accepts them confirms they may do so on the organisation's behalf.

The data processing agreement forms part of these terms. If they conflict about personal data, the data processing agreement wins.

2. The service

Everplace is software for managing rented homes: properties, tenancies, rent, compliance, repairs, documents, and portals for tenants, landlords and contractors. We improve it continually and may change how it works, but we won't remove a core part of it during a period you have paid for without telling you first.

3. Trial, plans and payment

  • Every new organisation has a 30-day free trial.
  • After the trial, the plan you choose in Settings → Billing is charged monthly in advance through Stripe. Prices are shown there and exclude VAT.
  • If a payment fails we tell you, and you have 14 days to pay. After that, paid features (such as Direct Debit collection, workflows, the API and white-label branding) pause until it is paid. Your data stays, and your tenants and landlords keep their access.
  • [Price changes: how much notice we give, and whether design partners pay during the pilot.]

4. Your account and your people

  • You decide who joins your workspace and what each person can do. You are responsible for what your people do in Everplace.
  • Keep sign-in details private and tell us at once if you think an account has been misused.
  • Tenants, landlords and contractors you invite use Everplace on your behalf. You are responsible for inviting the right people.

5. Your responsibilities

  • You remain responsible for meeting your legal duties as a landlord or letting agent, including tenancy, deposit, safety, licensing, client money and data protection law.
  • You must have a lawful basis for the personal data you put into Everplace and tell the people concerned how it is used.
  • Don't use Everplace for anything unlawful, to send unsolicited marketing, or to try to reach another organisation's data.

6. Not legal advice

Everplace's compliance rules, notice dates, agreement templates and guidance are based on published law and government guidance as we understand it, and we update them when the law changes. They are tools to help you, not legal advice. Check anything with legal effect, such as a notice or an agreement, before you rely on it, and take advice where you need it.

7. AI features

Some features use AI to read certificates, sort repairs and answer questions. AI can be wrong. Its readings are stored as unconfirmed until a person confirms them, safety rules can only make a repair more urgent, never less, and nothing with legal effect happens without a person approving it.

8. Payments you collect

Rent collected by Direct Debit goes to your own Stripe account, under your agreement with Stripe. Everplace never holds your money or your clients' money. Payouts to landlords are made by you from your own bank account; Everplace records them.

9. Your data

  • The data you put into Everplace is yours. We use it only to provide the service, as the data processing agreement sets out.
  • You can export your data at any time, and export or erase a person's data from their record.
  • When the agreement ends you can export your data for [30] days. We then delete it, except where the law requires us to keep it.

10. Availability and support

We aim to keep Everplace available at all times, apart from planned maintenance, and to answer support requests within [one working day]. [Service levels for paid plans, if any.]

11. Intellectual property

We own Everplace and its content, including the compliance packs and templates. You may use them while you use Everplace. You own your data and your own templates and wording.

12. Confidentiality

Each of us keeps the other's confidential information confidential and uses it only for this agreement, unless the law requires otherwise.

13. Liability

  • Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.
  • Neither of us is liable for loss of profit, revenue or goodwill, or for indirect loss.
  • Otherwise each party's total liability in any 12 months is limited to [the fees you paid in those 12 months].

14. Ending the agreement

  • You can cancel at any time in Settings → Billing. Paid plans run to the end of the period paid for.
  • We may suspend or end the agreement if you don't pay, break these terms seriously, or put other customers or Everplace at risk. Where we can, we will warn you first.

15. Changes to these terms

We may update these terms. We will tell owners and admins [30] days before a change takes effect and ask them to accept it. Each version and acceptance is recorded.

16. General

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If part of them can't be enforced, the rest still applies.
